Job Applicant Privacy Notice
Welcome to the Masimo Careers Site (the “Site”). This Site serves as the centralized career application portal for Masimo Korea and its corporate parent and affiliates. Masimo Korea (“Masimo” or “us”) may gather personal information from applicants (“Applicant” or “you”) during the recruitment process. This Applicant Privacy Notice (this “Notice”) is designed to enable Masimo to protect your personal information, and address related grievances, in compliance with South Korea’s Personal Information Protection Act (“PIPA”).
1. Personal Information Masimo May Collect About the Applicant
Masimo may collect and use your personal information for recruitment purposes. If you choose to apply for a position with Masimo, we may collect the following categories of personal information about you:
- Identifiers: name, postal address, phone number, e-mail address, Internet Protocol (IP) address, signature, nationality, and national veteran status (if applicable)
- Professional or Employment-Related Information: resume, employment history (e.g., dates/duration of employment, positions held), education history (e.g., degrees earned, certifications obtained), professional licenses and/or certifications and any information disclosed through LinkedIn profiles.
- Device, Internet or Other Similar Network Activity: Masimo may collect information regarding your interaction with the Site, including mobile device information and cookies. If you visit our offices during the recruitment process and use a guest WiFi, we may collect information about that use, such as type of device used and start/stop time. Masimo also may collect information from your publicly available social media content (other than LinkedIn).
- Non-Public Education Information: non-public education information (e.g., transcripts or other non-public education records).
- Medication Information: medical information (only if Masimo conducts a post-offer medical examination).
- Other Information Submitted with Online Application: (a) any personal information submitted as part of your responses to the application; (b) eligibility to work; and (c) salary expectations.
2. Masimo May Collect and Use Sensitive Personal Information
We may collect the following sensitive personal information about you in the recruiting process: medical information (only if we conduct a post-offer medical examination). We use the sensitive information that we collect about you for the purposes of evaluating your suitability for employment with us and for complying with our legal obligations. If we hire you, we may retain the sensitive information that we collect about you for the entire duration of your employment relationship with Masimo. If we do not hire you, we will retain your sensitive information for one year after the hiring decision has been made unless otherwise required by applicable law.
3. How Masimo Uses the Applicant’s Personal Information
Masimo may use the information that we collect about you for the following purposes:
Recurring:
- To evaluate your qualifications or suitability for employment with Masimo
- To communicate with you
- To check your references
- To conduct a pre-employment or criminal history background check (where permitted by applicable law)
- For identification purposes
- For diversity and inclusion purposes (where permitted by applicable law)
- For recordkeeping purposes
- To demonstrate your agreement to, or acceptance of, documents presented to you (e.g., pre-employment arbitration agreement, acknowledgment of employment application, offer letter)
- To evaluate and improve the recruiting process
- To comply with Masimo’s legal obligations and to defend against administrative charges or legal claims
If you visit our facilities
- To make travel arrangements
- To reimburse travel expenses
- To managed access to the facility
- To issue a security badge
- To maintain security during the visit.
- To monitor your use of the corporate Internet access if you connect to our guest WiFi during a visit to our offices
You may also choose to receive automated emails about positions within Masimo at the e-mail address you provided informing you of positions that may fit your profile. To stop receiving these emails at any time, you can click the "unsubscribe" link at the bottom of these emails.
If you are not hired for the position for which you initially apply, Masimo may use the information collected about you through the recruiting process to evaluate your suitability for future job openings. Based on that evaluation, Masimo may use your personal information to contact you to find out whether you are interested in applying for new job openings.
Our employees involved in the evaluation of the application and, if you are hired, in the administration of your employment relationship with Masimo will have access to your personal information on a need–to-know basis.
Masimo will not use your personal information that it may collect for any purposes other than the purposes described above. If these purposes of using your personal information need to be changed, Masimo will take measures, such as obtaining a separate consent from you, in compliance with Article 18 of the PIPA.
4. Retention of the Applicant’s Personal Information
If Masimo hires you, the information that you submit through the online application and the information that Masimo collects during the application process will become part of your personnel file and will be used to administer your employment relationship with us and for related reporting and recordkeeping purposes. Masimo will retain this information for the entire duration of your employment relationship with Masimo and for the period thereafter identified in Masimo’s Employee Privacy Notice, which is available on Masimo’s corporate intranet.
Masimo will retain the information of the Applicant who is not hired for one year after the hiring decision has been made unless otherwise required by applicable law. During that time, we may use your personal information to consider you for positions in addition to the position(s) for which you initially applied. If you want your personal information to be deleted, you can do so by contacting us at privacy@masimo.com, and we will delete your personal information without delay.
5. International Transfer of the Applicant’s Personal Information
The personal information that we collect about you in the recruitment process may be transferred to, and stored on, our servers located in the U.S. for purposes of facilitating the recruitment process with your consent. As part of the processing of your personal information on U.S. servers, your information may be accessed by Masimo Korea’s parent company Masimo Corp. and to the international headquarters Masimo International SARL. Masimo Corp. and Masimo International SARL can be contact at: (https://professional.masimo.com/company/contact/contact-us/). All items listed in Section 1 may be accessed by Masimo employees to the extent access is necessary for the purposes stated in Section 2 above, and for the retention period stated in Section 4 above. If you do not consent to the international transfer of your personal information, you may not be considered for employment with Masimo. If you do not want your personal information to be transferred overseas, you can contact Masimo at privacy@masimo.com.
6. Masimo May Use or Disclose the Applicant’s Personal Information Without the Applicant’s Consent
Notwithstanding the foregoing, Masimo may further use or disclose to third parties your personal information without your consent pursuant to Article 15, Paragraph 3 or Article 17, Paragraph 4 of the PIPA to the extent (a) related to the purposes described above; (b) foreseeable given the circumstances in which we collect the information and the practices of processing information; (c) not unreasonably prejudicial to your interests; and (d) protected by security measures such as encryption.
7. How Masimo Destroys the Applicant’s Personal Information
If you are not hired, Masimo will retain your personal information as stated in Section 4 above and as otherwise required by applicable law. Otherwise, we will destroy your personal information once the retention period expires or we are no longer required by law to retain your information. Personal information stored in the form of electronic files is permanently destroyed in a way that makes it irreversible. Personal information stored in paper documents is destroyed by shredding or incineration.
8. The Applicant’s Rights
To the extent provided by applicable law and subject to any relevant exceptions, you have the following rights:
- Right to Access: The right to request access to your personal information retained by Masimo.
- Right to Correct: The right to request that Masimo update or correct your personal information that is outdated or incorrect
- Right to Delete: The right to request that Masimo delete your personal information.
- Right to Withdraw Consent: The right to withdraw your consent to the further processing of your personal information.
- Right to Restrict Processing: The right to request that Masimo restrict or suspend the processing of your personal information.
- Right to Data Portability: The right to request that Masimo transfer your personal information to a third party.
9. How to Exercise the Applicant’s Rights
You can contact the Data Protection Office or privacy@masimo.com to exercise your rights. Masimo will respond to your request in compliance with the PIPA. Masimo may not accept your request to withdraw consent, to delete personal information or to restrict processing of personal information, if it is likely to harm the body, life or property of another person or infringe on interests of another person, or where necessary to comply with Masimo’s obligations under applicable law or otherwise provided by applicable law.
10. Authorized Agent
If an authorized agent submits a request to exercise your rights on your behalf, the authorized agent must submit with the request a document signed by you that authorizes the authorized agent to submit the request on your behalf. You can obtain an “Authorized Agent Designation” form by contacting us at privacy@masimo.com.
11. No Automated Decision-Making
Masimo will not use your personal information submitted through the Site for automated decision-making, including profiling, that produces legal effects or similarly significantly affects you.
12. Cookies
Masimo may collect cookies that are automatically generated during your visit to the Site. You have options to accept or refuse the cookies. Further information about our cookie policy is available here
13. Security for the Applicant’s Personal Information
Masimo has implemented reasonable and appropriate administrative, technical and physical safeguards to protect your personal information. For example, Masimo has implemented a security program to keep information that is transmitted to its systems protected from unauthorized access. Your submissions of information to our secure server are protected by Hypertext Transfer Protocol Secure (“HTTPS”) and Transport Layer Security (TLS) technology, utilized by many popular browsers to safeguard transmissions. This technology allows Masimo to use encryption tools to protect information transmitted between your computer and our server. After we have received your information, access to it is limited to employees with a need to know. Matters concerning the security for your personal information that are not set forth in this Notice will be determined by the requirements under Article 29 of the PIPA, Article 30 of the Enforcement Decree of the PIPA and the Standards for Measures to Secure the Safety of Personal Information.

15. Changes to This Notice
Masimo may change this Notice from time to time in its sole discretion. If we make a change to this Notice, we will inform you by posting a notice, and make available the new policy together with this Notice, on this Site.
